These Terms of Sale (“Terms”) govern your purchase of products and gift cards from kapowmeggings.com (the “Site”). By placing an order, you agree to be bound by these Terms.

Kapow Group Limited LLC is a Wyoming limited liability company. U.S. orders are fulfilled from our warehouse in Wyoming.

1. Eligibility

By placing an order, you represent that:

    • You have legal capacity to enter into a binding contract;
    • All information you provide is accurate and complete.

We reserve the right to refuse service to anyone at our discretion.

2. Formation of Contract

An order placed on our Site constitutes an offer to purchase.

You will receive an order confirmation email acknowledging receipt. This does not constitute acceptance.

A contract is formed only when we dispatch the product and send a shipping confirmation.

We may cancel or refuse any order at our sole discretion, including for suspected fraud, pricing errors, abuse of promotions, or unauthorized resale activity.

3. Pricing and Payment

Prices are displayed in U.S. dollars unless otherwise indicated.

We reserve the right to correct pricing errors at any time. If a pricing error is obvious or materially incorrect, we may cancel affected orders even after confirmation.

Payment must be made using an approved method available at checkout, including but not limited to:

Shopify Payments, Klarna, PayPal, Apple Pay, Google Pay, or Amazon Pay.

You authorize us to charge your selected payment method.

4. Promotions and Discount Codes

Promotional codes:

    • May be revoked at any time
    • May not be used for resale purposes
    • Are void where prohibited

We reserve the right to cancel orders that abuse promotional pricing.

5. Shipping and Delivery

Delivery dates are estimates only. We are not liable for carrier delays.

Risk of loss transfers upon confirmed delivery to the shipping address.

Title transfers upon full payment.

6. Returns and Exchanges

We offer a 30-day return period from delivery.

Returns must:

    • Be in original condition
    • Include original tags

Sale items are final sale and not eligible for return unless defective.

We offer free returns, but we may deduct a restocking fee unless the return is due to defect or exchange.

Defective products must be reported within 30 days of delivery.

We reserve the right to refuse returns that do not meet our policy.

7. Digital Gift Cards

Digital gift cards:

    • Are non-refundable
    • Are not redeemable for cash (except where required by law)
    • Cannot be replaced if lost or stolen

We reserve the right to cancel gift cards obtained fraudulently.

8. Unauthorized Resale

Products are sold for personal use only.

We reserve the right to cancel bulk orders suspected of resale.

Resale of used items is permitted, provided they are not represented as new or affiliated with Kapow Meggings.

9. Chargebacks and Fraud

If you initiate a chargeback without first contacting us to resolve the issue:

By purchasing, you acknowledge:

11. Reviews and User Content

    • You allow public display if submitted for publication

We reserve the right to moderate, edit, or remove content at our discretion.

12. Limitation of Liability

To the fullest extent permitted by law:

Our total liability shall not exceed the purchase price of the product giving rise to the claim.

We are not liable for:

16. Force Majeure

17. Dispute Resolution – Mandatory Arbitration

PLEASE READ CAREFULLY.

Any dispute arising out of or relating to these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You agree:

The arbitration shall take place in Wyoming unless otherwise required by law.

Each party shall bear its own costs unless the arbitrator determines otherwise.

If arbitration is found unenforceable, both parties waive the right to a jury trial to the fullest extent permitted by law.

19. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles.

20. Electronic Communications

You consent to receive communications electronically, which satisfy any legal requirement for written communication.

21. Assignment

We may assign or transfer our rights under these Terms at any time. You may not assign your rights without our written consent.

22. Severability

If any provision is found unenforceable, the remainder shall remain in full force.

23. Entire Agreement

These Terms constitute the entire agreement between you and Kapow Group Limited LLC regarding purchases from the Site.
